Elements of a valid DMCA notice

Under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must include substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list of works if multiple).
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate it (exact URL(s) on this site and, where possible, image or video ID).
  4. Contact information sufficient for us to reach you (name, postal address, telephone number, and email address).
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices may delay action. We may request clarifying information before processing.

What we do after receiving a notice

Upon receipt of a substantially compliant notice, we will promptly investigate and, where appropriate, disable access to or remove the allegedly infringing material. We typically act within 1–3 business days. We may notify the uploader or account holder that material was removed and provide a copy of the notice (with personal contact details redacted where required by law or policy).

Counter-notification

If you believe material was removed or disabled as a result of mistake or misidentification, you may send a counter-notification that includes substantially:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notice or their agent.

Upon a valid counter-notification, we may restore the material in accordance with § 512(g) unless the original complainant files an action seeking a court order and notifies us accordingly within the statutory period.

Repeat infringer policy

In appropriate circumstances, and in accordance with § 512(i), we disable and/or terminate accounts of users who are determined to be repeat infringers. We also accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, to the extent such measures are reasonable and do not impose substantial costs or burdens on our service.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing (or was removed by mistake) may be liable for damages, including costs and attorneys’ fees. Submit only accurate notices.
